SUMMARY STATEMENT:

The relief sought in the Complaint is the foreclosure of materialman’s lien by Plaintiff Rexel, Inc. dba Platt Electric Supply against real property owned by Anne Kellner, Trustee of The Sterling Trust, under Trust Agreement dated June 15, 2012 and, in the alternative, damages for unjust enrichment against Anne Kellner, Trustee of The Sterling Trust, under Trust Agreement dated June 15, 2012. The Property subject to Plaintiff’s claim of lien is located at 79117 Walters Road, Maupin, Oregon 97057.

DEMAND FOR RELIEF:

Plaintiff seeks for the lien against the Property to be foreclosed in the amount of $6,768.32 plus fees, costs, and interest, for Plaintiff’s lien to be declared first, valid, and subsisting against the Property and its improvements, that interests in the Property be sold by the Sheriff of Wasco County, Oregon in the manner provided by law to satisfy sums owed to Plaintiff and for Plaintiff to be permitted to purchase at the sale.  In the alternative, Plaintiff seeks damages in the amount of $6,768.32 against Anne Kellner, Trustee of The Sterling Trust, under Trust Agreement dated June 15, 2012 plus fees, costs, and interest, for unjust enrichment.
