NOTICE IS GIVEN that on July 2, 2019 at 11:00 A.M. at the Tropic Shores Condominium, Common Room, 3111 S. Atlantic Avenue, Daytona Beach Shores, FL 32118, the undersigned Trustee will offer for sale the following real properties as described in Schedule “A”.

The trustee foreclosure procedure outlined in Sections 721.855 and 721.856 Florida Statues was initiated on or about February 20, 2019 for Schedule “A” by TROPIC SHORES CONDOMINIUM ASSOCIATION OF VOLUSIA COUNTY INC., a Florida Corporation, of Volusia County, Florida whose address is 3111 S. Atlantic Avenue, Daytona Beach Shores, FL 32118, (the “Lienholder”) against the below-named obligors. 

Tropic Shores has appointed the following Trustee to conduct the trustee's sale as outlined in Sections 721.855 and 721.856 Florida Statues: Matthew R. Gross, J.D., P.A. as a Florida Professional Association, whose address is 1101 Douglas Avenue, Suite 1000, Altamonte Springs, FL 32714.

The timeshare interest and obligor(s), subject to this Notice of Sale are described as follows:

Unit Numbers and Week Numbers (as per Schedule “A” attached) in TROPIC SHORES, a condominium according to Book 3578, at Page 1553, and all amendments thereto, if any, of the Public Records of Volusia County, Florida.

The names of the obligor(s), together with Unit/Week Nos., and Assessments, are shown on Schedule “A” attached hereto. 

The obligor(s) has/have failed to pay maintenance fees and assessments on the timeshare pursuant to the Declaration of Condominium, as recorded in Official Records Book 3578 at Page 1553 in the Public Records of Volusia County, Florida, and any amendments thereof. As of the date of this Notice the total amount owed is listed in the attached Schedule “A”. Additionally, 0.00043% per diem will be charged to the obligor(s) account to account for further accrual of the delinquent amount. 

Any person claiming an interest in the surplus from the sales of the properties listed in Schedule “A”, if any, other than the property owner as of the date of the recording of this Notice, must file a claim within thirty (30) days after the date of this recording. 

The sale will be held pursuant to the obligor(s) failure to pay assessments as set forth in the Claim of Lien recorded in Official Records Book 7667 at Page 2225 in the Public Records of Volusia County, Florida, and any amendments thereof. 

The obligor(s) has/have a right to cure the default and any junior lien holder may redeem its interest up to the date the Trustee issues the Certificate of Sale which shall be issued on the sale date as set forth above, by paying in full with certified funds in the following amounts: (1) all past due sums, (2) costs of collection, (3) interest, as accrued to the date of payment, and (4) per diem, as accrued to the date of payment. IMPORTANT INFORMATION 

ABOUT YOUR DRINKING WATER 

Total Trihalomethanes (TTHM) MCL Violation at Orange City Utilities Public Water System

Our water system recently violated a drinking water standard. Although this incident was not an emergency, as our customers, you have a right to know what happened and what we are doing to correct this situation.

We routinely monitor for the presence of drinking water contaminants. Testing results from April 25, 2019, show that our system exceeded the standard, or maximum contaminant level (MCL), for TTHM. The standard for TTHM is 80 Parts Per Billion (ppb). It is determined by a locational running annual average (LRAA) of all the samples collected at each sampling location for the past 4 quarters. The level of TTHM averaged at two of our system’s locations for the 2nd quarter of 2019 was above 80 ppb (247 Minnesota Avenue: TTHM LRAA=81 ppb) (1038 West French Avenue: TTHM LRAA= 86 ppb).

What should I do?

 There is nothing you need to do. You do not need to boil your water or take other corrective actions. If a situation arises where the water is no longer safe to drink, you will be notified within 24 hours. 

If you have a severely compromised immune system, have an infant, are pregnant, or are elderly, you may be at increased risk and should seek advice from your health care providers about drinking this water. 

What does this mean?

This is not an emergency. If it had been an emergency, you would have been notified within 24 hours.

TTHM are four volatile organic chemicals which form when disinfectants react with natural organic matter in the water.

People who drink water containing trihalomethanes in excess of the MCL over many years may experience problems with their liver, kidneys, or central nervous system, and may have an increased risk of getting cancer. 

What is being done?

The City began construction on its Water Quality Improvement projects in 2015 using $1.7 million from the Utility Enterprise fund. An extra $13,549,405 in grant/loan funding was obtained from the FDEP State Revolving Funding (SRF) to reduce TTHMs.  

A unidirectional flushing program to remove stagnant water started in December 2014.  Existing obsolete and defective pipe replacement and pipe looping projects are under construction and expected to be completed in 2019.  To reduce TTHMs at the water treatment facilities, a new chlorine control and other water plant upgrades have been installed. The Water Treatment Plant upgrades was completed in January 2019.    The City is continuing to work hard to reduce the TTHM levels by flushing to remove stagnant water in the distribution system and upgrading the water treatment facilities.  

Orange City Utilities will continue to monitor and report the TTHM results on a quarterly basis in a public notice if the LRAA exceeds the MCL, as required by the Florida Department of Environmental Protection.
