I hope Volusia County will keep in mind that RLUIPA concerns any use of any organizsed church-owned property and not necessarily a church facility for worship alone. Many cases involving RLUIPA concern transitional living homes that otherwise might be illegal by proximity to other group homes, schools and day care providers (for ex-prisoners, drug rehab, teens, homeless shelters, food banks, and more). It involves historic preservation. It involves for-profit businesses on church properties and it involves schools. ANY use of church property is considered covered by RLUIPA and THAT is why it is dangerous not just to residential neighborhoods but entire communities at large. Whenever any single group (religious in this case) can evade ALL level of laws that ANY other secular concern or individual must obey, there is SPECIAL PRIVELEGE and a 2nd tier of law otherwise ILLEGAL under the U.S. Constituion. RLUIPA will ultimately be overturned in the Supreme Court some day but, until then, many communities and individuals will be forced to live with the dire consequences.
