Animal services, police departments, and code enforcement, depending on where you live, are responsible for the ultimate welfare of the animals. They act off of complaints and based on the evidence they have to go on. Judges do not grant search warrants with out proper cause. They may feel that the house where the animals were being kept could not appropriately care for that many animals. Once it goes to the judge they will make a decision based on the wellfare of the animals which may only enforce limits to how many or if animals can be returned to ARK, with routine inspections. Those that believe in no kill shelters sometimes live in a dream world, yes it can be done but you have to limit how many and what you take in. Aggressive animals are not adoptable, sick ones must get proper medical care before they can be adopted out if at all. Cats which are Felv or Fiv positive are not always easy to place. By limiting what you take in the rest end up at other shelters, which unfortunaly get labeled as kill shelters. Not because they want to euthanize, nobody in humane work wants to euthanize animals, but because space limits what can be done.
